In the framework of the transposition of the DSM directive in Italy, ICOM Italy submitted comments to the Senate. Among other things, they underline the benefits of adopting Article 14 on the public domain broadly, and highlight the many positive aspects that national open access policies would bring to culture, education and research.
Among other things, the consultation looks at how to effectively keep users safer online, reviewing the liability regime of digital services acting as intermediaries, what issues derive from the gatekeeper power of digital platforms or what governance to reinforce how to complete the Single Market for digital services. The legal reform to follow this consultation is likely to raise a lot of controversy, just like the “upload filters” article in the copyright Directive, as it will touch on sensible topics such as freedom of expression online.
The document highlights principles that the IFLA CLM group recommends pushing for in conversations that libraries may have with rights holders to ensure that access to content is maintained during remote working and learning. Some examples are that rightholders support openly online storytimes by librarians and educators where they are not already allowed; that rightholders provide open access to COVID-19 related material from all relevant disciplines; that rightholders enable the re-use of works such as for Text and Data Mining (TDM) purposes or that restrictions on interlibrary loans (ILL) for educational and research purposes during a time of crisis are lifted.
